DUI vs DWI
It is important to note that in NH, a DUI and DWI are considered the same charge. In NH, one can be charged with DWI, Aggravated DWI, DWI subsequent offense and in certain circumstances, a felony DWI.
DWI Charge as a Class B Misdemeanor
A DWI charge, even as a first time DWI offense, is a class B misdemeanor. While a class “B” misdemeanor is more favorable than a class “A” misdemeanor, a misdemeanor is still recorded on your criminal record and can cause you to lose out in the future on jobs, housing, loans, colleges, and more.
First Time DWI Penalties & Fees
If convicted of a DWI, first offense, the court will impose a mandatory minimum nine month loss of license and a $500 fine plus penalty assessment for a total of $620. In addition, you will be required to complete the Impaired Driver Care Management program and the Impaired Driver Education Program prior to license restoration. The state will require SR-22 insurance coverage for three years as well which is a surcharge assessed by your insurance company.
Administrative License Suspension
In addition to the court imposed loss of license referenced above, you are subject to a six month administrative license suspension that can run concurrent (at the same time) as the court imposed suspension (if convicted) or consecutive (after) the court imposed suspension (if convicted) depending on whether you submitted to a breath test.
